Parking License Agreement

By checking “I agree” at check-in you agree to this Agreement with South Gate Truck Services. If you do not agree, please do not park.
1. What this Agreement is
This Agreement gives you a limited, revocable license to park one permitted vehicle in one parking space assigned from available capacity for the period you pay for, whether you park immediately or reserve capacity in advance. It is not a lease of real estate and not a bailment. We do not take custody, control, or responsibility for your vehicle or its contents. You keep possession and control of your vehicle at all times, and you park at your own risk.
2. The lot and lot rules
You agree to follow all posted rules and signage and the directions of staff, including hours, speed limits, and anti-nuisance rules.
3. Permitted vehicles
Permitted vehicle types are bobtail tractors and truck-with-trailer combinations. You represent that your vehicle is legally registered, insured, and operable, and is not leaking fluids or otherwise hazardous.
4. Space assignment and reservations
Regular parking spaces are assigned on a first-available basis. We may assign or re-assign your space, including moving bobtails to overflow areas, to manage capacity.
If you pay for a reservation, you are purchasing a hold on compatible parking capacity for your selected window — not a guaranteed exact space. Reservations must start within the next 24 hours. Gate access begins at your selected arrival time, and your paid period ends at the selected end time whether or not you arrive. We do not automatically release or refund a reservation if you do not arrive; contact the manager for any adjustment.
5. Term — daily and monthly parking
- Daily parking: you select a number of days and pay in advance. Your space is yours until your stated end time.
- Monthly parking: you select a number of months and pay through an automatically renewing monthly subscription (see §7). Access continues until the paid-through date or until you cancel.
6. Payment authorization (one-time)
You authorize us, through our payment processor Stripe, to charge your selected payment method for daily parking, time extensions you request (§8), and overstay fees (§9). Prices are shown to you before you pay. All amounts are in U.S. dollars. We do not store your full card number.

You may extend a daily session before it ends by paying for additional days at the then-current daily rate. Monthly subscriptions renew instead of using extensions.

Refunds and cancellations are governed by our Refund & Cancellation Policy, which is incorporated into this Agreement.
11. Gate access, QR codes, and access codes
Entry and exit are controlled by a physical gate you operate by scanning a QR code (or, for authorized allow-list persons, by phone or a numeric access code). Opening the gate does not end or extend your session. Gate openings, denials, and related events are logged (date, time, direction, device, and outcome) for security and operations.
12. Nonpayment and access suspension
If a monthly payment fails or your account becomes past-due, we may suspend your gate access until the balance is resolved, consistent with applicable law. We may also pursue unpaid amounts as a debt you owe.
13. Your access codes, QR, and phone are your responsibility
You are responsible for use of your QR code, access code, and phone number. Sharing your code, QR, or phone number may allow others to open the gate. You must promptly report suspected unauthorized use. Selling, posting, transferring, or sharing access, and using another person’s access, are prohibited (§16).
14. Phone and device verification
If enabled, we may require you to verify your phone number by SMS and may associate a trusted device with your phone to streamline future access. Verification codes are time-limited. See our SMS Terms and Privacy summary.
15. No prohibited materials or hazardous storage
You may not store, transport, or leave hazardous, illegal, flammable, or prohibited materials in the lot, and may not use the space for repair, dumping, habitation, or storage of non-vehicle property except as permitted by posted rules. Additional prohibited conduct and the consequences of violations are described in §16.
16. Lot conduct; prohibited access behavior; enforcement
You agree not to misuse the lot, gate, cameras, QR codes, phone access, access codes, account, or session. Prohibited conduct includes, without limitation:
- Littering and dumping — littering, dumping trash, or leaving debris, fluids, oil, waste, cargo, pallets, tires, parts, or other property anywhere in the lot;
- Equipment tampering or damage — damaging, defacing, tampering with, or interfering with gates, cameras, fences, signs, lighting, payment systems, QR signs, sensors, or other equipment;
- Tailgating or pass-through — tailgating, allowing another vehicle or person to enter or exit through the gate using your access, or following another vehicle through the gate without your own valid access;
- Credential sharing or transfer — sharing, selling, posting, publishing, lending, or transferring any QR code, QR link, access code, phone credential, account, or session, or otherwise allowing unauthorized use of your access;
- Impersonation or unauthorized use — using another person’s phone number, access code, QR link, account, or session without authorization;
- Blocking — blocking entrances, exits, drive lanes, the gate, fire lanes, other vehicles, or assigned or occupied spaces;
- Nuisance or unsafe conduct — excessive noise, prolonged idling, fumes, nuisance, harassment, threats, unsafe driving, or other conduct that interferes with other customers, neighbors, or staff;
- Improper use of the lot — using the lot or a space for vehicle repair, maintenance, washing, habitation, dumping, storage of non-vehicle property, commercial activity, or any illegal activity, except as expressly permitted by us in writing or by posted rules.
Enforcement. If you violate this Agreement, posted lot rules, or staff instructions, we may, subject to applicable law: suspend or terminate your access; cancel your session; refuse you future parking; require payment of unpaid charges; charge or recover the reasonable cleanup, repair, replacement, towing, storage, administrative, or enforcement costs we actually incur; remove or tow your vehicle (§18); retain video and access logs as evidence; and/or contact law enforcement. A violation may result in termination without an automatic refund of unused prepaid time, subject to our Refund & Cancellation Policy and applicable law. Our choice not to enforce a rule on one occasion is not a waiver.
17. Risk of loss; no liability for damage or theft
You park at your own risk. To the fullest extent permitted by law, we are not liable for theft of, damage to, or loss of your vehicle, its contents, or any property in the lot, whether caused by other customers, third parties, weather, or otherwise, except to the extent caused by our gross negligence or willful misconduct. You are responsible for insuring your vehicle and property.
18. Towing, removal, and abandoned vehicles
We may tow or remove, at the vehicle owner’s expense and subject to applicable Texas towing and notice law, vehicles that are unauthorized, in violation of these terms or posted rules, blocking access, unregistered or inoperable, or abandoned.
19. System and gate outages
Gate hardware, network, payment, and software may occasionally be unavailable. We are not liable for inconvenience from outages and will make reasonable efforts to restore service or provide alternative access or egress. Outages do not waive amounts you owe.
20. Force majeure
We are not liable for failure or delay due to events beyond our reasonable control, including natural disasters, utility or network failures, governmental actions, labor disputes, or third-party provider failures.

22. Privacy and data
We collect and process your information as described in our Privacy & Data Use summary, including sharing with Stripe (payments), QuickBooks/Intuit (accounting), Twilio (SMS), and our hosting provider. By using the service you acknowledge that summary.
23. Automated processing and logs
You acknowledge that certain actions are automated: overstay status is computed by scheduled system checks; reminders and alerts may be sent automatically; gate events and account actions are logged; and staff may manually open the gate or adjust your session. Accounting records kept for bookkeeping do not override the payment records held by Stripe and us.
24. Electronic acceptance and signature
You agree to transact electronically. Checking “I agree” and proceeding constitutes your electronic signature and acceptance under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act. We record the version you accepted and the time.
25. Changes to terms
We may update this Agreement. The version in effect when you check in governs that session; material changes apply to future check-ins and renewals. Continued use after changes constitutes acceptance.
26. Governing law and venue
This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.
27. Miscellaneous
If any provision is unenforceable, the rest remains in effect. This Agreement, together with the Refund & Cancellation Policy, SMS Terms, and Privacy summary, is the entire agreement about parking in the lot. Our failure to enforce a provision is not a waiver.
